TinyNurture Terms of Service

These Terms of Service (“Terms”) form an agreement between you and Anqi Hu, a Swiss sole proprietor operating under the business and product name TinyNurture (“TinyNurture”, “we”, “us” or “our”). Current provider details, the address for legal service and the support/legal email are published in our Impressum at https://tiny-nurture.com/en/impressum/. TinyNurture is not currently registered in the Swiss Commercial Register and does not currently have a UID.
These Terms govern your access to and use of the TinyNurture mobile application, its AI assistant, related websites, accounts and services (together, the “Service”). The licence for the iOS application is also subject to Apple’s Standard Licensed Application End User License Agreement. If these Terms conflict with mandatory law or the Apple Standard EULA, the mandatory rule or the Apple Standard EULA controls to the extent of the conflict.
1. Acceptance and important notices
By creating an account, selecting “I agree” or using the Service, you agree to these Terms. You must be able to view and save the Terms before accepting them.
Please read in particular Sections 4 (not medical care), 5 (AI limitations), 13 (free Beta), 18 (warranties) and 19 (liability). Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded.
Our Privacy Policy is separate from these Terms. Acceptance of these Terms does not by itself constitute consent to processing health data. Where consent is required, TinyNurture will request it separately and allow you to withdraw it, subject to the consequences explained at that time.
2. Eligibility and accounts
You must be at least 18 years old and legally capable of entering into a contract to create or use an account. The Service is designed only for adults. It does not provide child accounts, dependent profiles or a child-directed AI service. You must not create an account for a child or submit a child’s health-related information during the Beta.
You must provide accurate account information, keep your credentials secure and notify us promptly using the contact details in our Impressum at https://tiny-nurture.com/en/impressum/ if you suspect unauthorised access. You are responsible for activity performed through your account unless it resulted from circumstances for which you are not legally responsible.
You may not transfer, sell or share your account in a way that compromises the privacy of any person whose information is recorded in the Service.
3. Invitation-only adult Beta
The current Service is a small, invitation-only, free Beta for selected adult testers. An invitation is personal, may be limited in time and does not create a right to permanent access, general availability or future paid features.
Beta features may be incomplete, change frequently, contain defects or lose test data. You should not use the Beta as the only copy of important information. We may limit the number of testers, pause new invitations or end the Beta on reasonable notice, subject to rights that cannot lawfully be excluded.
The Beta is intended for invited adults in Switzerland only where TinyNurture has confirmed that the Service is legally and technically available. Availability in an App Store does not itself confirm that registration or use is permitted in every country.
4. Wellness service only — not medical care
TinyNurture is intended for personal wellness tracking, organisation, reflection and general educational information. It is not a healthcare provider, medical professional, emergency service or substitute for one. The Service is not intended to diagnose, prevent, monitor, predict, treat or alleviate any disease, injury or medical condition, and is not intended to make clinical decisions.
Do not use the Service:
- to diagnose or treat a condition;
- to decide whether to take, stop or change medication or treatment;
- as the sole basis for decisions concerning pregnancy, an infant, a child, allergies, eating disorders or any other potentially serious condition;
- to calculate a medically required dose or dietary restriction; or
- in an emergency or when delay could cause harm.
If you believe someone may be in danger, has severe or rapidly worsening symptoms, or needs urgent help, contact the appropriate local emergency service or a qualified healthcare professional immediately. Do not wait for a response from TinyNurture.
Information from TinyNurture should be checked against reliable sources and, where health decisions are involved, discussed with a qualified professional who knows the relevant person’s circumstances.
5. AI-generated outputs and estimates
The Service includes artificial intelligence. You are interacting with an AI system when using the TinyNurture assistant or an AI-supported analysis.
AI output is probabilistic and may be inaccurate, incomplete, outdated, inconsistent or inappropriate. It may misunderstand text, voice, images, context, dates, quantities or the person to whom information relates. It can present incorrect information confidently.
Food recognition, portion sizes, calories, nutrients, activity expenditure, patterns, correlations and predictions are estimates. A single photograph or short description cannot establish exact ingredients, hidden oils, preparation methods, portion weight, allergens or nutritional values. Displayed ranges and confidence indicators do not remove this uncertainty.
You must review and, where possible, correct captured information before relying on it. TinyNurture does not guarantee that an event was recorded, transcribed, classified or attributed correctly.
Any relationship identified between events is an observed association, not proof of causation. Predictions describe uncertain possibilities, not future facts.
6. HealthKit and other data sources
Access to Apple HealthKit is optional and controlled through Apple’s system permissions. TinyNurture requests access only to data types used by enabled features. You can change HealthKit permissions in Apple’s settings, although doing so may limit the Service.
HealthKit, wearables, sensors, manual entries and third-party services may contain missing, delayed, duplicated or inaccurate data. TinyNurture does not control those sources and does not guarantee their availability or accuracy.
TinyNurture must not use HealthKit-derived health or fitness data for advertising, marketing or sale. Our separate Privacy Policy explains which data are processed, which information remains on the device and which information is transmitted.
Do not use TinyNurture as the only place to retain information that you must keep for medical, legal or safety reasons.
7. Photos, voice and user content
You retain ownership of text, photographs, voice recordings, corrections, profile information and other content you provide (“User Content”).
You grant TinyNurture a limited, non-exclusive licence to host, transmit, format, reproduce and process User Content only as reasonably necessary to:
- provide the features you request;
- maintain security, prevent abuse and troubleshoot the Service;
- comply with law and enforce these Terms; and
- perform another purpose to which you separately consent.
This licence ends when the relevant content is deleted, except where limited retention is required by law or persists temporarily in rolling backups as described in the Privacy Policy.
You must not upload content that you do not have the right to use, or information about another person without a valid legal basis and, where required, that person’s consent.
Voice recordings selected for transcription are transmitted to our service and to the disclosed speech-to-text provider for transient processing. Photographs selected for analysis are transmitted for analysis. The Privacy Policy and the just-in-time notice shown for the feature together describe the provider or recipient category, processing location, retention and deletion path in effect at the time of use.
8. Feedback
If you voluntarily submit product feedback, screenshots or feature proposals, you grant TinyNurture a worldwide, perpetual, royalty-free, non-exclusive right to use, reproduce, adapt and implement the non-personal ideas contained in that feedback. This does not transfer ownership of your personal data or allow health data to be used for an unrelated purpose.
No subscription credit, free month or monetary reward is offered during the current Beta. Any future feedback programme will be governed by separately published terms and will never require a positive App Store rating or review.
9. Acceptable use
You may not:
- use the Service unlawfully, fraudulently or to harm another person;
- use the Service to provide medical diagnosis, treatment or emergency services to third parties;
- upload malware or attempt unauthorised access, probing or interference;
- bypass usage limits, invitations, authentication or safety controls;
- scrape the Service or use automated access except through an authorised interface;
- copy, reverse engineer, modify or derive source code except where applicable law expressly permits it;
- use output to create deceptive content or falsely represent it as professional advice; or
- infringe privacy, confidentiality, intellectual-property or other rights.
We may investigate suspected misuse and take proportionate action, including restricting access, preserving relevant evidence where lawful and terminating an account.
10. Intellectual property
Except for User Content and third-party materials, TinyNurture and its software, design, branding, documentation and service content are owned by us or our licensors and protected by applicable law.
Subject to these Terms and the Apple Standard EULA, you receive a personal, limited, revocable, non-exclusive, non-transferable right to use the Service for private, non-commercial purposes. No other rights are granted.
11. Privacy and data protection
Our Privacy Policy forms the authoritative notice about personal-data processing. It must identify the controller, purposes, legal bases, categories of data and recipients, international transfers, retention periods, data-subject rights, withdrawal methods and contact channels.
TinyNurture processes health-related information only for disclosed purposes and does not sell health data or use it for advertising. We may use service providers acting under contract. The Privacy Policy identifies the relevant recipient categories, processing countries and transfer safeguards. TinyNurture maintains a current internal provider register and discloses specific recipients where required by law or to obtain valid consent.
You may request access, correction, deletion or export as described in the Privacy Policy. Rights are subject to applicable law and lawful retention requirements.
12. Service availability, beta features and changes
TinyNurture is an evolving service. Features may be marked beta, preview or experimental. They may have additional limitations and may change or be withdrawn.
We do not promise uninterrupted availability. Maintenance, security incidents, network failures, provider outages, regulatory requirements or events outside our reasonable control may interrupt the Service.
We may modify the Service to improve functionality or security, comply with law, prevent abuse or adapt to technical requirements. We will provide reasonable advance notice of a material change that negatively affects an ongoing paid service where required by law. Mandatory rights to terminate or obtain remedies remain unaffected.
13. Free Beta and future paid services
TinyNurture does not charge a subscription fee and does not offer paid subscriptions, referral rewards or feedback rewards during the current Beta. No payment method is required by TinyNurture for Beta access.
If TinyNurture later introduces a subscription or another paid service, it will show the product, billing period, full price, renewal terms, cancellation method and any trial or promotion before purchase. A paid service will require any new acceptance or purchase confirmation required by law. Participation in the free Beta does not enrol you automatically in a paid plan.
14. Support
For support and legal enquiries, use the contact details in our Impressum at https://tiny-nurture.com/en/impressum/. We will use reasonable efforts to respond, but the support channel is not continuously monitored and must not be used for emergencies or time-critical health matters.
Apple has no obligation to provide maintenance or support for TinyNurture.
15. Suspension and termination
You may stop using the Service at any time and may request account deletion through the in-app deletion flow.
We may suspend or terminate access where reasonably necessary because of a material breach, security risk, unlawful use, risk to another person, or a legal or provider requirement. Where appropriate and lawful, we will give notice and a reasonable opportunity to remedy the issue.
Termination does not remove rights or liabilities that arose before termination. Sections that by their nature should survive, including intellectual property, lawful feedback rights, warranty limitations, liability and dispute provisions, continue to apply.
16. Third-party services and Apple
The Service depends on third-party infrastructure and services. Their availability and outputs are outside our complete control. Your use of Apple services remains subject to Apple’s terms.
These Terms are between you and TinyNurture, not Apple. TinyNurture, not Apple, is responsible for the Service, its content, support and claims relating to it. Apple and its subsidiaries are third-party beneficiaries of the provisions that relate to the iOS application and may enforce those provisions after your acceptance.
17. No professional relationship
Use of TinyNurture does not create a doctor-patient, dietitian-client, therapist-client, fiduciary or other professional relationship. Any information about the operator’s background or qualifications does not convert the Service or AI output into individual professional advice.
18. Warranties and statutory rights
To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available”. We do not warrant that it will be uninterrupted, error-free, secure, complete or accurate, or that it will achieve a particular health, fitness, nutritional or commercial result.
We do not warrant AI output, food or calorie estimates, transcriptions, predictions, correlations or information received from third parties.
This Section does not exclude any statutory guarantee, conformity obligation or consumer remedy that cannot lawfully be excluded. In jurisdictions that do not permit a particular disclaimer, it applies only to the maximum extent permitted.
19. Limitation of liability
Nothing in these Terms excludes or limits liability for intentional misconduct, gross negligence, fraud, death or personal injury to the extent caused by a breach for which liability cannot lawfully be excluded, or any other liability that mandatory law does not permit us to exclude or limit.
Subject to the preceding paragraph and to the maximum extent permitted by law:
- TinyNurture is liable only for direct loss that was reasonably foreseeable when the contract was formed;
- TinyNurture is not liable for indirect, incidental, special, punitive or consequential loss, or loss of profit, opportunity, goodwill or data;
- TinyNurture is not liable for a decision made contrary to Sections 4 or 5, or for errors in information supplied by you, a device, sensor or third-party service; and
- TinyNurture’s aggregate liability arising from slight negligence is limited to the greater of the fees you paid for the Service during the twelve months before the event giving rise to the claim or CHF 100.
The limitations are intended to allocate foreseeable risk and do not reduce mandatory consumer, data-protection, product-liability or digital-service rights. If a limitation is invalid, it will be reduced only to the minimum extent needed to make it enforceable.
20. Responsibility for unlawful third-party content
If you use the Service for business purposes, you will compensate TinyNurture for a final third-party claim, reasonable cost or damage directly caused by your knowing unlawful upload or your material breach of another person’s rights. This provision does not apply to consumers to the extent it would remove or unfairly restrict mandatory rights, and it does not cover a loss caused by TinyNurture.
21. Changes to these Terms
We may update these Terms for legal, security, technical or service reasons. We will state the effective date and make the current version available in the Service.
For a material change, we will provide reasonable notice. Where law requires renewed consent, we will ask for it before the change applies. Changes do not retroactively reduce rights already accrued.
22. Governing law and disputes
These Terms are governed by Swiss law, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods.
If you are a consumer, this choice does not deprive you of mandatory protection under the law of your habitual residence, and you may use any court or dispute mechanism available to you under mandatory law. Otherwise, the courts of the Canton of Zug, Switzerland, have exclusive jurisdiction.
Before starting formal proceedings, you and TinyNurture should attempt in good faith to resolve the dispute through the contact in our Impressum at https://tiny-nurture.com/en/impressum/, unless urgent relief or mandatory law makes that inappropriate.
23. General terms
If any provision is unenforceable, the remaining provisions continue in effect, and the invalid provision is limited or replaced only to the extent legally permitted. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a lawful transfer of the Service, provided this does not reduce mandatory consumer rights.
These Terms, the Apple Standard EULA and the Privacy Policy constitute the agreement relating to the current Beta. Specific feature terms control over these Terms only for that feature.
English, German and Simplified Chinese versions are provided for the launch audience and are intended to have the same meaning. The English version is the reference text for resolving a drafting discrepancy, but this rule does not override mandatory interpretation or language rights of a consumer.
